FK Prevails in Cannabis Investment Fraud Arbitration

FK represents MJV Capital LLC in an arbitration against HMP Trading Inc., Philip Kent Cooke, and Andrew Peterson, asserting securities and common law fraud related to investments in an Oklahoma-based cannabis venture, Pharma Bio Supply, LLC.

At the August 2024 hearing, FK’s strategic presentation and incisive cross-examination of the respondents’ key witness led the arbitrator to find at least five material misrepresentations and deem the witness’s testimony unreliable. The arbitrator awarded MJV Capital the full amount of its claimed damages, including pre-judgment interest, $250,000 in punitive damages, and full attorneys’ fees and costs. FK then successfully confirmed the award in Alameda County Superior Court and secured final judgment.
