FK represents a New York adult-use cannabis dispensary in a federal lawsuit contesting the labor peace agreement(“LPA”) requirement under the state’s Marihuana Regulation and Taxation Act. The suit argues that conditioning cannabis licensure on entering into an LPA directly conflicts with the National Labor Relations Act, which preempts state regulation of labor relations, raising significant constitutional and statutory concerns.
